As LFJ reported last week, in the wake of the Supreme Court’s PACCAR decision, many advocates for the litigation funding industry have suggested that only the government can rectify the situation through new legislation that would more clearly define the place of litigation funding agreements (LFA). However, it appears that an initial attempt to manufacture a legislative shortcut through an amendment to the proposed bill will not be successful.
